These Terms of Service ("Terms") govern your use of the DayNest website and your purchase of DayNest products. By using our site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

DayNest is operated by DAYNEST PTY LTD (ABN: 51 694 705 443, ACN: 694 705 443), based in Adelaide, South Australia ("DayNest," "we," "us," "our").

1. Eligibility

You must be at least 18 years old and able to enter a binding contract under Australian law to place an order.

2. Products and pricing

All prices are in Australian dollars (AUD). DAYNEST PTY LTD is not currently registered for GST, so no GST is charged on purchases. We reserve the right to change prices, modify product specifications, or discontinue products at any time. Product images are for illustration purposes; minor variations may occur.

3. Orders

When you place an order, you make an offer to purchase. We accept your order when we send an order confirmation. We may decline or cancel any order at our discretion — including for suspected fraud, pricing errors, stock unavailability, or breach of these Terms. If we cancel an accepted order, you'll receive a full refund.

4. Payment

Payment is required at the time of order. We accept the payment methods displayed at checkout. You confirm that the payment information you provide is accurate and that you are authorised to use it.

5. Shipping and delivery

Shipping costs, methods, and timeframes are set out in our Shipping Policy. Risk of loss passes to you upon delivery.

6. Returns and refunds

Your rights to return faulty, damaged, or incorrect goods are protected under the Australian Consumer Law and detailed in our Returns & Refunds Policy. We do not offer change-of-mind returns.

7. Sense.aio AI service

DayNest products are powered by Sense.aio, a third-party AI service that enables features such as email-to-calendar extraction, smart scheduling, and contextual displays. Your use of Sense.aio is governed by Sense.aio's own terms of service and privacy policy, which you accept separately when activating your device.

Sense.aio is operated independently of DayNest, and we do not control its features, availability, integrations, or future changes. Continued access to Sense.aio's AI features beyond the included service period may require a separate subscription paid to Sense.aio. Pricing and terms for any ongoing subscription will be disclosed at the time of purchase and on the relevant product pages.

8. Intellectual property

All content on the DayNest website — including text, images, logos, designs, and software — is owned by DayNest or its licensors and protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.

9. Acceptable use

You agree not to use our site to: (a) breach any law; (b) interfere with the site's security or operation; (c) submit false or misleading information; or (d) infringe the rights of any other person.

10. Limitation of liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

To the maximum extent permitted by law, our total liability for any claim arising under or in connection with these Terms is limited to the amount you paid for the relevant product. We are not liable for any indirect, consequential, or special loss.

11. Privacy

Our collection and use of your personal information is governed by our Privacy Policy and the Privacy Act 1988 (Cth).

12. Changes to these Terms

We may update these Terms from time to time. The current version is always available on our website with the "last updated" date shown above. Continued use of the site after changes constitutes acceptance.
